Solving Cargo Damage Dispute In Transportation By Maersk
Our client imported frozen fish from Uruguay by carrier MAERSK, when received and opened container, found that cargo had changed color, from white to gray, quality was deteriorated. Then Client asked attorney of Win & Win law firm for help. Attorney appointed Investigation Company to investigate cargo at port. Investigator’s opinion was that refrigerator stopped running for 24 hours during transportation, then caused cargo damage. On behalf of client, attorney submitted this case to Qingdao Maritime Court, claimed the carrier to bear responsibility for cargo damage. After court hearing, Judge considered that plaintiff had investigation report by third party indicated that cargo damage was caused by refrigerator of container, and the carrier did not provide evidence showing it took care of cargo carefully and prudently throughout journey, so judged that carrier shall compensate all damaged and interest in this case.
